Drug driving

Alex Muddiman-Kell, 26, appeared for sentencing on a number of drug charges and one dangerous driving charge.

Several of the charges were withdrawn as they were above Magistrate O’Brien’s sentencing powers.

The final charges were one of dangerous driving, one for procuring cannabis and one for procuring ecstasy.

Muddiman-Kell had been driving down the highway from Rakaia to Ashburton in early November.

As he approached the passing lanes, he “crossed over double yellow lines on the wrong side of the road, and overtook approximately six cars,” O’Brien read from the fact summary.

Police stopped him and searched his car, finding two ecstasy tablets and a small amount of cannabis. He admitted to police he had consumed some cannabis when he’d earlier stopped in Rakaia.

Muddiman-Kell pleaded guilty to all of the charges.

“His main misdemeanour was the dangerous driving, and overtaking on yellow lines,” lawyer Clare Yardley said.

“His history’s virtually nil.”

O’Brien disqualified the man for seven months and ordered him to pay $1300 in fines, as well as court costs.
